1. Definitions

• "Platform" refers to Darapana, including its website, applications, and associated services.
• "User" refers to any individual, entity, organization, or body accessing or using the Platform.
• "Services" refers to aggregation, listing, display, and facilitation services offered by the Platform.

2. Nature of Services (Aggregator Disclaimer)

The Platform operates strictly as an intermediary and aggregator, facilitating connections between Users, space owners, advertisers, and other third parties. The Platform does not own, control, endorse, or manage any listings, content, displays, or services, and shall not be deemed a party to any transaction or arrangement between Users.

3. Limitation of Liability

To the fullest extent permitted by applicable law, the Platform shall not be liable, directly or indirectly, for any acts, omissions, representations, or misconduct of Users or third parties, content posted or displayed through the Platform, or activities of any individuals, NGOs, social groups, religious bodies, or political organizations. The Platform makes no warranties regarding accuracy, legality, or reliability of content or suitability of services.

4. Compliance with Applicable Laws

All Users agree that activities conducted via the Platform shall comply with all applicable Indian laws and regulations, including municipal corporation laws, local body and taluk regulations, district administration rules, and urban and rural governance laws. This includes rules applicable to space owners, media/display owners, and indoor and outdoor advertising. Users are solely responsible for obtaining necessary permissions, licenses, and approvals.

5. User Responsibilities

Users shall ensure that all content and activities are lawful, accurate, and non-misleading and do not violate public order, morality, or legal provisions. Users must not use the Platform for unlawful, fraudulent, or harmful purposes or activities that infringe the rights of others.

6. Indemnity

The User agrees to indemnify, defend, and hold harmless the Platform, its directors, employees, and affiliates from and against any claims, damages, losses, liabilities, or expenses arising from use or misuse of the Platform, violation of applicable laws, infringement of third-party rights, or content submitted or actions taken by the User.

7. Limitation of Damages

In no event shall the Platform be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if the Platform has been advised of the possibility of such damages.

8. Force Majeure

The Platform shall not be held liable for any failure or delay in performance caused by events beyond reasonable control, including natural disasters, government actions, war, strikes, civil unrest, or network or system failures.

9. Content and Third-Party Interaction

The Platform does not verify or guarantee third-party content. All interactions, transactions, and engagements are solely between Users and third parties. The Platform shall not be responsible for disputes arising from such interactions.

10. Termination of Access

The Platform reserves the right to suspend or terminate access to any User at its sole discretion and remove content that violates these Terms or applicable laws.

11. Jurisdiction and Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

12. Amendments

The Platform reserves the right to modify or update these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Legal Disclaimer & Limitation of Liability

The Platform shall not be held liable or responsible, directly or indirectly, for any acts, omissions, representations, or content associated with any visible or non-visible entity, organization, social group, welfare institution, NGO, individual, or any religious (whether registered or unregistered), political, or non-political body engaging with or through the Platform. Darapana operates strictly as an intermediary and aggregator platform, facilitating connections between parties. Any disputes shall be governed by the laws of India and shall fall under the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka.
